Terms of Service

Section 01

The Service

Choyens is a tool that helps people organize and join in-person, recreational sports meet-ups (pickup games). The App lets you:

• Create or join groups built around a sport or community.
• Post events at a real-world venue with a date, time, sport, and roster.
• RSVP to events, check in at the venue, and get matched into the next game.
• Record match results, track points, and view leaderboards.
• Chat with the members of an event or group, including sharing photos within those chats.
• Receive notifications about events, matches, and chats that involve you.
• Block, report, or remove users from your events and groups.

The App is a coordination tool. It does not host, sponsor, supervise, or otherwise participate in the in-person activities you organize through it.

Section 02

Eligibility

You must be at least 13 years old to create an account. If you are under 18 (or the age of majority in your jurisdiction), you may use the App only with the involvement and consent of a parent or legal guardian.

Section 03

Your Account

You sign in to Choyens using your existing Apple ID or Google account. You agree to:

• Use accurate information for your profile (display name, sports, bio).
• Keep your sign-in credentials secure. You are responsible for all activity under your account.
• Notify us promptly if you believe your account has been accessed without your permission.

You may delete your account at any time from inside the App (Profile → Settings → Delete Account). See Section 12 for details.

Section 04

Your Content

You retain ownership of the content you create in the App, including event titles and descriptions, group names and descriptions, your bio, sport selections, match scores, chat messages, chat photos, avatars, group cover photos, event banners, comments on reports, and any other text or images you submit (“Your Content”).

By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute Your Content solely to operate and improve the App and provide it to you and the other users you choose to share it with (e.g., your group members, event attendees, chat recipients). This license ends when you remove the content or close your account, except where retention is required by law or to maintain the integrity of historical records (e.g., past match results stay attributed to the players who took part).

You represent that you have all rights necessary to grant this license and that Your Content does not violate these Terms or any law.

Section 05

Acceptable Use

You agree not to use the App to:

• Post or share content (text, images, or otherwise) that is unlawful, hateful, threatening, harassing, defamatory, sexually explicit, or otherwise objectionable.
• Impersonate another person, group, or organization.
• Harvest, scrape, or otherwise collect information about other users without their consent.
• Send spam, advertising, or promotional content, including in chat messages.
• Share images you do not have the right to share, including images that infringe another person’s intellectual property or privacy rights.
• Reverse engineer, decompile, or attempt to extract the source code of the App, except where that restriction is prohibited by law.
• Interfere with the operation of the App, including through automated tools, scraping, or denial-of-service attempts.
• Use the App to facilitate any activity that violates law, regulation, or the rights of others.

We may remove content, suspend accounts, or terminate access to the App if you violate these rules. We use the moderation tools described in Section 6 to enforce them.

Section 06

Reporting and Moderation

The App provides tools for you to keep your experience safe:

• Delete your own messages. You can long-press any of your own chat messages and delete them at any time. Deletion is permanent for everyone in the chat.
• Report another user’s message. You can long-press any other user’s chat message and report it. Reported messages are immediately hidden from your view, the reporter’s identifier is recorded, and the message is flagged for moderation.
• Block a user. You can block any other user from your profile screen. Blocked users no longer appear in your search results, you no longer receive messages from them, and their content is hidden from your view.
• Three-strike auto-removal. If a user’s messages accumulate three distinct, valid reports inside the same group, that user is automatically removed from the group. The group’s creator and admins are exempt from auto-removal but remain subject to manual moderation.

We review reports as we are able, but we do not guarantee that any specific report will result in action. You acknowledge that user-generated content reflects the views of the individual user, not Choyens. We may remove content, suspend, or terminate any account at our discretion to enforce these Terms.

Section 07

In-Person Events — You Organize, You’re Responsible

The App helps you coordinate meet-ups, but the actual events happen offline, at venues you select, with people you choose to play with. This includes:

• Confirming venue availability, court bookings, fees, and access.
• Following the rules of the venue and any applicable local laws.
• Assessing whether the activity is appropriate for your fitness and skill level.
• Resolving disputes between participants.

We do not vet, supervise, insure, or take responsibility for any in-person event organized through the App.

Section 08

Advertising

The App may display non-personalized banner ads served by Google AdMob. By using the App, you acknowledge that ads may appear in certain views once your account is at least 30 days old. We do not share your personal information with Google AdMob, and we do not track you across other apps for advertising purposes. See the Privacy Policy, Section 6, for full detail.

Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OR RELIABILITY OF ANY USER-GENERATED CONTENT, EVENT DETAILS, MATCH RESULTS, OR CHAT MESSAGES.

Section 10

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHOYENS AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US TO USE THE APP IN THE PRIOR TWELVE MONTHS, OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN OF THESE LIMITATIONS, IN WHICH CASE THE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

Section 11

Indemnification

You agree to indemnify and hold harmless Choyens, its contributors, and its affiliates from any claim, damage, loss, liability, cost, or expense (including reasonable attorneys’ fees) arising out of or relating to: (a) Your Content, (b) your use of the App, (c) your violation of these Terms, or (d) your violation of any rights of another.

Section 12

Termination and Account Deletion

You may stop using the App at any time. To delete your account, open the App, go to Profile → Settings → Delete Account, and follow the prompts. Account deletion:

• Removes your name, email, phone, bio, sport preferences, and personal blocklist.
• Renames your historical event and match records to “Former player” so the leaderboards and event archives stay coherent.
• Deletes your chat messages and any chat photos you sent.
• Removes you from the read-receipt records on chats you participated in.
• Scrubs your user ID from moderation flagger lists.
• Deactivates your push notification tokens.

We may suspend or terminate your access if we reasonably believe you have violated these Terms, infringed another user’s rights, or created risk for us or other users.

Section 13

Apple-Specific Terms

If you obtained the App through the Apple App Store, you acknowledge:

• These Terms are between you and Choyens, not with Apple Inc. (“Apple”).
• Choyens, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). Apple has no other warranty obligations.
• Choyens is responsible for product liability and intellectual-property claims relating to the App, to the extent not disclaimed by these Terms or applicable law.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Section 14

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the App, by email, or through other reasonable means before the changes take effect. Your continued use of the App after the changes are effective means you accept the updated Terms.

Section 15

Governing Law and Disputes

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App will be resolved in the courts of Quezon City, Metro Manila, unless the user is a consumer in a jurisdiction that requires a different venue, in which case those local consumer-protection rules apply.
